We are in full pandemic with the new COVID-19. We have travel restrictions in other countries, but also in Romania. A number of military ordinances were approved, which "restricted" the freedom of movement of citizens. It is a measure of social distance, with the purpose of spreading the virus.

The recommendation is to stay in houses and leave only in emergencies and of maximum necessity. Those in isolation at home or in institutionalized quarantine DO NOT WANT to leave the premises.

In this situation, there were also many questions regarding travel outside the home. To some it may seem urgent, but let's see what he says Strategic Communication Group.

🔴1. Question: Can the shuttle go to work during this period? Who live in Ilfov, for example, and work in Bucharest?

Answer: According to the provisions of the Military Ordinance no. 3 of 24.03.2020 regarding measures to prevent the spread of COVID-19, art. 1, point a "The movement of all persons outside the home / household is prohibited, with the following exceptions ... travel in professional interest, including between home / household and the place (s) of professional activity and back".

Thus, the normative act stipulates that the movement between the house and the workplace is allowed. It is not mentioned that the place where the professional activity is carried out must be the same as that of the domicile. According to your example, a citizen living in Ilfov can travel to the workplace in Bucharest, provided he has the documents provided in art. 4 of the aforementioned ordinance, namely the service card, the certificate issued by the employer or a statement on his own responsibility.

🔴2. Question: How far from our home can the specialist doctor's office be located? Can we go for this consultation from Cluj to Bucharest, for example?

Answer: There is no distance limit at which the medical office must be located, but we recommend that citizens travel for medical purposes, other than major emergencies, only after checking the availability of doctors.

🔴3. Question: At what maximum distance from home can the commercial unit be located where we can shop? Can we go shopping, for example, from the Berceni neighborhood to a hypermarket in Militari?

Answer: The provisions of the Military Ordinance no. 3 of 24.03.2020 regarding measures to prevent the spread of COVID-19 does not mention a quantifiable distance, but the recommendation for citizens is to go to the nearest shops where the necessary products are marketed.

In strict reference to your example, a citizen living in the Berceni neighborhood cannot go shopping for products of strict necessity in the Militari neighborhood, as there are several hypermarkets in the home area similar to those in the Militari neighborhood.

🔴4. Question: Could a resident of Bucharest go, for example, to take medicines and food to his parents domiciled in Vaslui County?

Answer: The above mentioned normative act does not impose a distance limit. Regarding your specific question, yes, a citizen of Bucharest can go to Vaslui to take care of his parents.

🔴5. Question: What does it mean in kilometers, for example, "short commute, near home"? Should joggers just run around the block or on the adjacent streets? What is the maximum distance allowed?

Answer: The physical, sporting activities must be carried out around the home or the place where the citizens actually live, around the house, the house, the block and not in parks, playgrounds, sports fields, etc. We also remind that collective physical activities are prohibited.

🔴6. Question: Should pets just walk around the block or can their owners go to nearby parks? How much are they allowed to move away from home?

🔴7. Question: Can an agricultural producer in Cluj, for example, come to sell potatoes in Bucharest?

Answer: In the case of minors under 16, the declaration must be completed and signed by one of the parents or the legal guardian. Minors between the ages of 16 and 18 complete and sign the declaration on their own responsibility, indicating that they must respect the individual conditions of travel and that they are prohibited from participating in collective physical activities. Also, minors between the ages of 16 and 18 will also have identity documents on them.

🔴10. Question: Can I drive my wife to / from work?

Answer: If you consider that the reason for the trip is a justified one, you can do so by filling in the declaration on your own responsibility regarding the provision of art.1 letter d (moving for justified reasons, such as caring / accompanying the child, assisting the elderly, sick or disabled or dead of a family member).

As can be seen, the situations included in the norm are exemplary in nature, but they imply grounds of a certain importance.
Such a situation could be justified if there is no means of public transportation or if the risk of exposure to infection is higher (moving to the workplace would mean changing more means of public transportation, waiting times at stations, etc.) .

For the driver over 65 years of age it is advisable to avoid such trips outside the time period 11.00-13.00.

🔴11. Question: Can I bring my grandmother over the age of 65 from her home to our home address, which is located at a greater distance, in another county?

Answer: This possibility is provided by art. d of the Military Ordinance no.1.

If the trip to bring an elderly person (over 65 years) is done in order to be taken care of or to provide medical treatment, we recommend that this trip be done with a predilection during the time period 11-13 or not exceed very much much this interval. Watch out for speed!

🔴12. Question: Can I go out to pay my bills on utilities or bank rates, or sign contracts with a notary?

Answer: The provision of art.3 of the Military Ordinance no.3 concerns only the pedestrian displacement and not the public transport. However, it is important to comply with the general measures to prevent the spread of COVID 19, including by keeping a free seat between passengers.
The explanation is also valid for the transport organized by the economic operators for moving the employees to / from the workplace.

🔴14. Question: My periodic technical inspection of the car expires. Is its validity extended or should I go to do it?

Answer: The validity of the ITP is not extended, according to the decision of the Romanian Auto Registry. The journey to carry out the ITP verification at the approved stations can be done, being considered an activity to cover the basic needs of the people, situation provided in point 2 of the declaration on their own responsibility.

🔴15. Question: If I have a friend who comes by plane from another country can I take him from the airport?

Answer: This reason is not provided as an exception in the text of the Military Ordinance no. 3. But, if the person does not have to move from the airport to the place of domicile or the place where he is going to reside, then the displacement is allowed, completing the declaration on his own responsibility, having the motive to help the people.

It should be borne in mind that citizens arriving from the red zones enter into institutionalized quarantine, so they cannot be taken from the airport by relatives, relatives or friends, and those coming from the yellow areas enter into isolation. This implies that the person coming into contact with them must follow the same self-isolation procedure.

🔴16. Question: My RCA insurance expired. Is its validity extended? If not, can I get out of the house to get my insurance?

Answer: The validity of RCA insurance is not extended. It can also be purchased online. For this reason, traveling to pick up the RCA policy can NOT be considered an emergency and is NOT a reason that can be considered an emergency or to ensure the needs of the person.

🔴17. Question: Can I go to a city other than my home town where I have the opportunity to stay in a home that is not personal property, but gives me better conditions for the family (two children aged 7 and 4 years respectively and to stay in self-isolation?

Answer: In the Military Ordinance number 3, it is not provided that citizens must remain at their home address, but at a location indicated by them, in compliance with the legal provisions and restrictions imposed. Thus, we mention that it is permissible even to travel with the family in the rural area, if the people own a house there, to stay in the respective locality.

🔴18. Question: Can I move to another locality to provide food and medicine to some of the animals I care for, without being mine?

Answer: Not. This reason is not provided as an exception in the text of the Military Ordinance no. 3, except for the provision of this activity in a professional context, including regarding agricultural activities.

🔴19. Question: Can I move to get my wife and minor child from the hospital?

Answer: Yes. Based on the statement on your own responsibility you state that your travel is for a justified reason. A similar statement will also need to be completed by the wife.

🔴20. Question: Can I go to a house I have under construction to supervise the work done by the workers?

Answer: Not. This reason is not provided as an exception in the text of the Military Ordinance no. 3.

🔴21. Question: The suspension of the retail business activity in the shopping centers also applies to the Commercial Parks as defined in the GO no. 99/2000?

🔴23. Question: Is it possible to move the parent to exercise the right to visit the child in the care of the other parent?

Answer: This reason is not provided as an exception in the text of the Military Ordinance no. 3, but the rights stipulated by the notarial or judicial judgment of divorce regarding the parental rights can be exercised. Specifically, the minor child can be taken home by the non-dependent parent, within the period established in the divorce decision.

🔴24. Question: Do I have to complete the declaration on my own and those who go to work?

Answer: Military Ordinance no. 3/2020 clearly stipulates “the employees present the service card OR the certificate issued by the employer”, so it is necessary to present one of the two mentioned documents.

🔴25. Question: Do we need to complete the declaration on our own responsibility, regardless of why we leave the house? Even if we go to the street corner kiosk or to the food market near the block?

Answer: The military ordinances in force clearly regulate the reasons and the manner in which the movement of all persons outside the home / household is carried out, as well as in particular the movement of persons who have reached the age of 65 years.

In the provision regulating the movement for the supply of goods that cover the basic needs of the persons, there is no exception conditional on the proximity of the food unit, meaning that the order is applied unitary regardless of the distance to which the store is located.

🔴26. Question: If we go to the pharmacy, buy a drug, or to the store next to the house, for sugar, and do not find the products we are looking for, can we try another pharmacy / store nearby? Or do we have to go back home and fill out another declaration for the new place of travel?

Question: If a person has several properties (apartments, houses, etc.) where he does not live and wants to check them (to move to the same locality or to another locality), he could do so without violating the provisions of the Ordinance military? If so, what should be ticked in the statement, at the "reason for moving"?

🔴33. Question: Can I go to the notary office during this period to perform notarial documents?

🔴34. Question: In the case of journalists, photojournalists and video cameramen, who may be forced to travel longer distances, between cities, for different reports, is it possible to travel in the country for several days, in the interest of work?

Answer: The military ordinances in force regulate the movement of all persons outside the home / household. There is no stipulated distance limit for traveling in the professional interest and no time limit, relative to a certain number of days. Also, regardless of the period in which the professional activity is carried out, it is necessary to respect the conditions established by the military ordinances regarding the holding of the supporting documents. (the work card or the certificate issued by the employer).

🔴35. Question: For liberal professions, such as writers or artists, who retire to creative houses to complete their work, or for those who have their residence in other areas, mountainous or more remote, how can they move to these places where to remain during the state of emergency?

Answer: According to the Military Ordinance no. 3, art. 4 "the authorized natural persons, the holders of the individual enterprises, the members of the family businesses, the free professionals and the persons who practice agricultural activities present a declaration on their own responsibility, completed in advance." above, it is necessary to complete a declaration on your own responsibility.

🔴36. Question: In the Military Ordinance no. 4 specifies that "(3) The prohibition on the movement of persons in a group of more than 3 persons applies exclusively to pedestrian circulation." Juridically, this may mean that in the open space of an institution, such as the court of a church, Can I find out more than three people, following the safety rules, because it is not a pedestrian area?

Answer: In the Military Ordinance no. 1 in Article 2 is provided that "All cultural, scientific, artistic, religious, sports, entertainment or gambling, spa treatment and personal care activities, carried out in confined spaces, shall be suspended." In the Military Ordinance no. 2 art. 9 it is stipulated that "services may be held in places of worship by church / religious servants, without public access, jobs may be transmitted in the media or online" and that "liturgical / religious acts of a private nature may be officiated (baptism). , weddings, funerals), in which a maximum of 8 persons can participate, as well as the sharing of the sick believers in the hospital or in their domicileˮ.

Military Ordinance no. 3 in art. 1 prohibits the movement of all persons outside the home / household, with certain exceptions. Among the exceptions mentioned is not mentioned the movement to a place of worship for prayer.
Thus, by corroborating all the mentioned articles, in reference to your example, there is no justification for the presence of more people in the church yard, if they are for purposes other than those allowed by the legislative framework. (professional purposes, attending a funeral service, etc.).

🔴37. Question: Those who are obliged to go to banks for various subsistence transactions - withdrawal of money, etc. -, what should tick in the Declaration on their own responsibility not to receive a fine?

Answer: The reason for the move is clearly justified. In this respect, the declaration on its own responsibility can be completed in relation to the provision of art.1 letter d of the Military Ordinance no. 3 of 2020.

As can be seen, the situations included in the norm in art.1 letter. d are exemplary in nature, but they involve grounds of some importance. Such a situation, such as the one presented by you, could be justified, given that the amounts of money are needed to cover the basic needs. At the same time, in order to avoid surface contamination, we recommend the use of bank cards for shopping.
