The National Committee for Emergency Situations adopts the decision no. 8 of February 10, 2021. According to it, the state of alert is extended in Romania by 30 days, from February 12, 2021.

Art.1 - It is proposed to extend the alert status on the entire national territory, for a period of 30 days, starting with 12.02.2021.
Art.2 - The measures for the prevention and control of infections generated by the SARS-CoV-2 virus, necessary to be adopted starting with 12.02.2021, in the current epidemiological context, are provided in the annex to this.
Art.3 - This decision is communicated to all components of the National Emergency Management System, for implementation by order and administrative acts of their leaders.

INFECTION PREVENTION AND CONTROL MEASURES PROPOSED TO BE APPLIED DURING THE WARNING

1. The operational coordination of the ambulance services and of the voluntary services for emergency situations by the county inspectorates / Bucharest-Ilfov for emergency situations is maintained, as well as of the local police by the General Police Directorate of Bucharest / the county police inspectorates .

2. The obligation to ensure the continuity of the activity of residential care and assistance centers for the elderly, residential centers for children and adults, with and without disabilities, as well as for other vulnerable categories and the obligation to establish the work schedule of employees with the approval of public health county, respectively of the municipality of Bucharest.

3. The obligation of residential social service providers to organize their program according to the existing epidemiological context at local level and in compliance with the rules in force on labor legislation shall be maintained. The activity at the level of these services will be organized and carried out in compliance with the rules for preventing the spread of the SARS-CoV-2 virus established by the competent authorities.

4. The obligation to permanently carry out the activity of all operative centers for emergency situations with temporary activity, as well as of the National Center for Coordination and Management of the Intervention and of the county / Bucharest centers for coordination and management of the intervention is maintained.

It is proposed to maintain weekly testing, with the care of the public health directorates, care and assistance staff, specialist and auxiliary staff working in residential care and assistance centers for the elderly, residential centers for children and adults, with and without disabilities, as well as for other vulnerable categories.

10. Physical training activities within sports structures and bases, consisting of training camps, training and sports competitions organized in Romania may be carried out only under the conditions established by the joint order of the Minister of Youth and Sports and the Minister of Health.

11. Sports competitions may be held on the territory of Romania without spectators, only under the conditions established by the joint order of the Minister of Youth and Sports and the Minister of Health.

12. Under the conditions of point 10, it is allowed to carry out by professional, legitimate and / or performance athletes the physical training activities in indoor or outdoor pools, and the physical training activities in closed spaces are allowed only in compliance with the rules. distance between participants, so as to ensure a minimum of 7 sqm / person.

13. The activities of museum institutions, libraries, bookstores, cinemas, film and audiovisual production studios, performance and / or concert institutions, folk, art and craft schools, as well as outdoor cultural events take place only in the conditions established by the joint order of the Minister of Culture and the Minister of Health.

14. Under the conditions of point 13 the organization and development of cinemas, performance institutions and / or concerts is allowed, with the participation of the public up to 50% of the maximum capacity of the space, if the cumulative incidence in the last 14 days of cases in the county / locality is less than or equal to 1,5 / 1.000 inhabitants, with public participation up to 30% of the maximum capacity of the space, if the cumulative incidence in the last 14 days of the cases in the county / locality is higher than 1,5 and lower or equal to 3 / 1.000 inhabitants and is prohibited from exceeding the incidence of 3 / 1.000 inhabitants.

15. 16. The activity of religious services, including collective services and prayers, is carried out inside and / or outside places of worship in accordance with the rules of health protection, established by joint order of the Minister of Health and the Minister of Internal Affairs.

17. Under the conditions of point 16, in order to prevent the spread of SARS-CoV-2 infections, the organization of religious processions and / or pilgrimages is permitted only with the participation of persons who have their domicile or residence in the locality where the activity takes place. who do not have their domicile or residence in the localities where these activities take place.

18. It is proposed to maintain the ban on outdoor recreational and sports activities, with the exception of those carried out with the participation of no more than 10 persons not living together, established by joint order of the Minister of Health, as appropriate, with the Minister of Youth and Sport, the Minister of Environment, Water and Forests or the Minister of Agriculture and Rural Development.

19. It is permitted to carry out activities for the prevention and control of African swine fever by collective hunters with a maximum of 20 participants.

20. It is proposed to maintain the ban on the organization of private events (weddings, baptisms, festive meals, etc.) in closed spaces such as, but not limited to, salons, cultural centers, restaurants, bars, cafes, event halls / tents. .

24. It is proposed to maintain the organization and conduct of specific activities in the diplomatic field, including at the headquarters of diplomatic missions and consular offices accredited in Romania, so as to ensure an area of ​​at least 4 square meters for each participant and compliance with health protection rules.

25. It is proposed to maintain the organization of rallies and demonstrations with a maximum number of participants of 100 people and to comply with the following measures:

a) wearing a protective mask, so as to cover the nose and mouth, by all participants;
b) mandatory disinfection of hands, for all persons arriving in the space where the rally or demonstration takes place;
c) maintaining the physical distance of at least 1 meter between the participants and ensuring an area of ​​at least 4 sqm / person where possible;
d) disinfection of the hands of the persons who distribute any materials during the rally or demonstration;
e) application of collective and individual hygiene rules to prevent contamination and limit the spread of SARS-CoV-2 virus.

26. It is proposed to maintain the traffic ban within the localities for persons in pedestrian groups larger than 6 persons who do not belong to the same family, as well as the formation of such groups.

27. It is proposed to maintain the traffic ban in all localities, for all persons, outside the dwelling / household during the time interval 2300-0500, with the following exceptions motivated by:

a) travel in professional interest, including between home / household and the place / places of professional activity and back;
b) travel for medical assistance that cannot be postponed or performed remotely, as well as for the purchase of medicines;
c) travel outside the localities of persons who are in transit or make journeys whose time interval overlaps with the period of interdiction, such as those made by plane, train, coach or other means of passenger transport and which can be proved by ticket or any other way of paying for the trip;
d) travel for justified reasons, such as caring for / accompanying the child, assistance to the elderly, sick or disabled or death of a family member.

28. When verifying the reason for moving in professional interest, provided in point 27 let. a), the persons are obliged to present, at the request of the personnel of the competent authorities, the service card or the certificate issued by the employer or a declaration on their own responsibility.

29. When verifying the reason for traveling in personal interest, provided in point 27 let. b) -d), the persons are obliged to present, at the request of the staff of the competent authorities, a declaration on their own responsibility, completed in advance.

30. The self-declaration, provided for in points 28 and 29, must include the name and surname, date of birth, address of the home / place of work, reason for travel, date of completion and signature.

31. It is proposed to maintain the ban on the entry into the territory of Romania, through the state border crossing points, of foreign citizens and stateless persons, with the following exceptions:

a) family members of Romanian citizens;
b) family members of the citizens of other member states of the European Union or of the European Economic Area or of the Swiss Confederation, with residence in Romania;
c) persons who hold a long-stay visa, a residence permit or a document equivalent to the residence permit issued by the authorities or a document equivalent to them issued by the authorities of other states, according to the legislation of the European Union;
d) persons traveling in a professional interest, proven by visa, residence permit or other equivalent document, respectively medical staff, researchers in the medical field, medical staff for geriatric care, carriers and other categories of personnel involved in the transport of goods that provide such necessary transports;
e) the personnel of the diplomatic missions, consular offices and of the international organizations, as well as the members of their families that accompany them in permanent missions on the Romanian territory, the military personnel or the personnel that can provide humanitarian aid;
f) persons in transit, including those repatriated as a result of the granting of consular protection;
g) passengers traveling for imperative reasons;
h) persons in need of international protection or for other humanitarian reasons, persons subject to the provisions of Regulation (EU) no. Regulation (EC) No 604/2013 of the European Parliament and of the Council of 26 June 2013 establishing the criteria and mechanisms for determining the Member State responsible for examining an application for international protection submitted in one of the Member States by a third-country national or a stateless person and persons returned on the basis of readmission agreements;
i) foreigners and stateless persons traveling for study purposes;
j) foreigners and stateless persons, highly qualified workers, if their employment is necessary from an economic point of view, and the activity cannot be postponed or carried out abroad;
k) aliens and stateless persons, cross-border workers, seasonal workers, maritime and river navigating personnel;
l) the members of the international sports delegations that participate in sports competitions organized on the Romanian territory, in accordance with the law;
m) the members of the film or audiovisual production filming teams, the technical and artistic staff that participate in the cultural events that take place on the Romanian territory, based on proven contractual relations or supporting documents.

32. Unless otherwise regulated at national level, the measure set out in point 31 shall no longer apply to foreign nationals and stateless persons originating in or residing in third countries from which, at European level, it is established to lift temporary restrictions on non-essential travel to the European Union. .

33. The zonal quarantine can be established under the conditions of art. 7 and 12 of Law no. 136/2020 on the establishment of measures in the field of public health in situations of epidemiological and biological risk, republished with subsequent amendments and completions.

34. It is proposed to maintain the competence of the National Committee for Emergency Situations to adopt measures to suspension of flights by aviation economic operators to and from countries with a high epidemiological risk, which were established by decision of the National Committee for Emergency Situations at the proposal of the National Institute of Public Health.

35. The following categories of flights are exempted from the provisions of point 34:

a) performed with state aircraft;
b) transport of goods and / or correspondence;
c) humanitarian or providing emergency medical services;
d) for search-rescue or intervention in emergency situations, at the request of a Romanian public authority;
e) with the purpose of transporting the technical intervention teams, at the request of the economic operators established in Romania;
f) non-commercial technical landings;
g) positioning of aircraft, without commercial ferry type cargo;
h) techniques for performing works on aircraft;
i) performed by air carriers holding an operating license in accordance with European Union regulations, by irregular flights (charter), for the transport of seasonal workers or for the repatriation of foreign nationals, from Romania to other states, with the approval of the Romanian Civil Aviation Authority and the competent authority of the State of destination;
j) performed by air carriers holding an operating license in accordance with European Union regulations, by irregular flights (charter), from other states to Romania for the repatriation of Romanian citizens, with the approval of the Romanian Civil Aviation Authority, based on the agreement of the Ministry of Internal Affairs and Ministry of Foreign Affairs;
k) carried out by air carriers holding an operating license in accordance with European Union regulations, by irregular flights (charter), for the transport of workers in the transport sector provided in Annex no. 3 to the Communication on the implementation of Green Lanes under the Guidelines on border management measures to protect health and ensure the availability of essential goods and services - C (2020) 1897, of 23.03.2020, from Romania to other states and from other states to Romania, with the approval of the Romanian Civil Aeronautical Authority and of the competent authority of the destination state.

36. It is proposed to maintain the ban on road transport of persons by occasional services, as well as to supplement regular travel, in accordance with the regulations in force, in order to participate in religious processions and / or pilgrimages to places where these activities take place.

37. It is proposed to maintain the temporary closure, in whole or in part, of the following state border crossing points:

37.1 at the Romanian-Hungarian border: Carei, Satu Mare county.

37.2 at the Romanian-Bulgarian border:
a) Lipnița, Constanța county;
b) Dobromir, Constanța County;
c) Bechet, Dolj County (except for freight traffic).

37.3 at the Romanian border with the Republic of Moldova: Rădăuți-Prut, Botoșani County;

37.4 at the Romanian-Serbian border:
a) Moldova Nouă, Caraş-Severin County;
b) Vălcani, Timiș County;
c) Stamora-Moravița, Timiș County - railway (except for freight traffic);
d) Lunga, Timiș County;
e) Foeni, Timiș County.

38. It is proposed to continue the program with the public of economic operators engaged in the preparation, marketing and consumption of food and / or alcoholic and non-alcoholic beverages, such as restaurants and cafes, inside buildings, not exceeding 50% of maximum capacity. of the space and only in the time interval 0600-2300, in the counties / localities where the cumulative incidence of cases in the last 14 days is less than or equal to 1,5 / 1.000 inhabitants, without exceeding 30% of the maximum capacity of the space and in time interval 0600-2300, if the cumulative incidence in the last 14 days of the cases in the county / locality is higher than 1,5 and less than or equal to 3 / 1.000 inhabitants and is prohibited when the incidence exceeds 3 / 1.000 inhabitants.

40. The measures provided for in points 38 and 39 shall also apply to economic operators who carry out activities in public spaces which have a roof, ceiling or ceiling and which are delimited by at least 2 walls, regardless of their nature or temporary or permanent nature.

41. In the event that the activity of the economic operators referred to in points 38 and 39 is restricted or closed, the preparation of food and the marketing of food and alcoholic and non-alcoholic beverages not consumed in those premises shall be permitted.

42. The economic operators referred to in points 38 and 39 shall comply with the obligations established by order of the Minister of Health and the Minister of Economy, Entrepreneurship and Tourism.

The preparation, marketing and consumption of food and alcoholic and non-alcoholic beverages are permitted in specially designed outdoor spaces.

43. 46. ​​As an exception to the provisions of point 45, in the time interval 2100-0500, economic operators may operate only in relation to economic operators with home delivery activity.

47. With the exception of the provisions of point 45, in the time interval 2100-0500, pharmaceutical units, petrol stations, economic operators with home delivery activity, as well as economic operators in the field of road transport of persons using motor vehicles with a capacity of more than 9 seats, including the driver's seat and those in the field of road transport of goods using vehicles with a maximum authorized mass of more than 2,4 tons, may operate normally, in compliance with health protection regulations.

48. Within the shopping centers where several economic operators operate, it is not permitted to operate playgrounds, game rooms and the activity of bars, clubs and discos.

49. It is proposed that air transport continue to be carried out in compliance with measures and restrictions on hygiene and disinfection of common areas, equipment, means of transport and aircraft, procedures and protocols inside airports and aircraft, rules of conduct for airport staff, and for informing staff and passengers, in order to prevent contamination of passengers and personnel operating in the field of air transport, under the conditions established by joint order of the Minister of Transport and Infrastructure, the Minister of Health and the Minister of Internal Affairs.

50. It is proposed that rail transport continue to be carried out in compliance with measures and restrictions relating to the hygiene and disinfection of common areas in stations, stops, stations or stopping points, train equipment and fittings, procedures and protocols inside stations, stops. , stations or stopping points, but also inside wagons and train sets, the degree and occupancy of rolling stock, the rules of conduct for operators and passengers, as well as for informing staff and passengers, in order to prevent contamination of passengers and staff working in the field of rail transport, under the conditions established by joint order of the Minister of Transport and Infrastructure, the Minister of Health and the Minister of Internal Affairs.

51. It is proposed that road transport continue to be carried out in compliance with measures and restrictions relating to the hygiene and disinfection of means of transport of persons, procedures and protocols within means of transport, the degree and occupation of means of transport, rules of conduct for operator and passenger personnel, as well as on informing personnel and passengers, in order to prevent contamination of passengers and personnel working in the field of road transport, under the conditions established by joint order of the Minister of Transport and Infrastructure, the Minister of Health and the Minister of Internal Affairs.

52. It is proposed that shipping should continue to be carried out in compliance with measures and restrictions relating to the hygiene and disinfection of passenger ships, the procedures and protocols inside passenger ships, the degree and occupation of passenger ships, the rules of conduct for operators and passengers, as well as for informing staff and passengers, in order to prevent contamination of passengers and personnel working in the field of shipping, under the conditions established by joint order of the Minister of Transport, Infrastructure and Communications, the Minister of Health and the Minister internal affairs.

53. It is proposed that the domestic and international transport of goods and persons continue to take place, under the conditions established by joint order of the Minister of Transport and Infrastructure, the Minister of Health and the Minister of Internal Affairs.

54. The suspension of the activity of economic operators carried out indoors in the following areas: activities in swimming pools, playgrounds and games rooms shall be maintained.

55. The activity with the public of licensed economic operators in the field of gambling is allowed without exceeding 50% of the maximum space capacity in the counties / localities where the cumulative incidence of cases in the last 14 days is less than or equal to 1,5 / 1.000 of inhabitants, without exceeding 30% of the maximum capacity of the space, if the cumulative incidence in the last 14 days of the cases in the county / locality is higher than 1,5 and less than or equal to 3 / 1.000 inhabitants and is forbidden to exceed incidence of 3 / 1.000 inhabitants.

56. It is proposed to maintain the obligation for public institutions and authorities, economic operators and professionals to organize the activity so as to ensure, on entry into the premises, mandatory epidemiological triage and mandatory hand disinfection, both for their own staff and for visitors, under the conditions established by joint order of the Minister of Health and the Minister of Internal Affairs.

57. The obligation is maintained that the activity at the level of dental offices and non-COVID health units, be carried out only under the conditions established by the order of the Minister of Health.

58. The obligation of economic operators carrying out gambling activities, personal care, tourist reception with accommodation functions, as well as office work activities with common spaces in an open system to comply with the prevention rules established by the joint order of the Minister is maintained. economy, entrepreneurship and tourism and the Minister of Health, on the basis of which they can carry out their activity.

59. Economic operators carrying out gambling activities have the obligation to respect the working hours with the public and the restrictions established by decision of the National Committee for Emergency Situations, at the proposal of the Technical-Scientific Support Group on the management of highly contagious diseases in Romania or of the county / municipality committee of Bucharest for emergency situations. The measures shall be established for administrative-territorial units where there is an intense Community spread of the virus and / or an increasing number of persons infected with the SARS-CoV-2 virus.

60. The obligation of economic operators carrying out activities of outdoor swimming pools, outdoor swimming pools or sports / fitness halls to comply with the prevention rules established by the joint order of the Minister of Youth and Sports and the Minister of Health shall be maintained.

61. The obligation of economic operators carrying out spa treatment activities to comply with the prevention rules established by order of the Minister of Health is maintained.

62. The obligation is maintained that the activity in nurseries and after-schools, be carried out only in compliance with the conditions established by joint order of the Minister of Education, the Minister of Labor and Social Protection and the Minister of Health. 63. 64. It is proposed that in the event of 3 cases of SARS-CoV-2 illness in an interval of 7 consecutive days, in the spaces intended for the accommodation of pupils or students, the measure of closing the building for a period of 14 days be instituted. For pupils / students who do not have the possibility to go home or another location, the responsible educational unit ensures the accommodation in quarantine conditions, as well as the necessary measures to support the provision of basic needs.

65. It is proposed to maintain the suspension of the activity of fairs, fairs and flea markets, defined according to art. 7 para. (1) of the Government Decision no. 348/2004 on the exercise of trade in market products and services in some public areas.

66. In order to limit the spread of SARS-CoV-2 infections, the activity of agri-food markets, including flying ones, shall be carried out under conditions established by joint order of the Minister of Development, Public Works and Administration, the Minister of Agriculture and Rural Development and the Minister of Health. and the Minister of Labor and Social Protection.

67. In order to limit the spread of SARS-CoV-2 infections, the use of slopes and / or ski slopes for recreation, as well as the organization and development of the activity of economic operators who operate / maintain them shall be done under the conditions established by joint order of the Minister of Economy. , Entrepreneurship and Tourism, the Minister of Development, Public Works and Administration, the Minister of Health and the Minister of Labor and Social Protection.

68. It is proposed to maintain the obligation to organize the work schedule in telework or home work for all employers where the specificity of the activity allows this work.

69. In order to avoid congestion in public transport, in the event that telemployment or work at home cannot be carried out, it is proposed to maintain the obligation to organize the work schedule by employers in the private system, central public authorities and institutions; and regardless of the method of financing and subordination, as well as the autonomous utilities, national companies, national companies and companies in which the share capital is wholly or mainly owned by the state or by an administrative-territorial unit, with more than 50 employees , so that the staff is divided into groups to start or finish the activity at a difference of at least one hour.

70. The ascertainment of the classification within the limits of cumulative incidence of the cases for the last 14 days in order to implement the measures established in this decision is made within maximum 48 hours from their reaching by decision of the county / municipality committee for emergency situations. based on the analyzes presented by the county public health directorates, respectively of the Bucharest municipality, and the measures are applied for a period of 14 days, and will be re-evaluated at the end of it.

71. The county public health directorates, respectively of the Bucharest municipality, calculate daily, for each locality from the competence area, the cumulative incidence of cases for the last 14 days and present to the county / Bucharest municipality committee for emergency situations, the analysis 24 hours from the date of finding that the limits established in this decision have been reached.

72. The daily calculation provided in point 70 shall be made by reference to the figure representing the sum of persons domiciled or residing in the reference locality, communicated to the county / municipality committee for emergency situations by the Directorate for Personnel Records and Database Administration from within the Ministry of Internal Affairs, through the county territorial structures, on the first working day of the week, at 1600. The figure communicated by the Directorate for Personnel Records and Database Administration through the county territorial structures is used as a reference for the entire period until the provision a new updated dataset.
