TAROM planes could remain on the ground, from December 1! The United TAROM union threatens to strike!

The Tarom trade union warns that, starting from December 1, no more planes will fly unless the company is exempted from the provisions of Law 296/2023 regarding some fiscal-budgetary measures.

"In the situation where TAROM will not be exempted from the provisions of this Law of "national shameand other capital companies state majority, but who do not necessarily work in a competitive market will be exempted, we, the members of the TAROM United Trade Union (SUT), starting December 1, 2023, pilots, flight attendants, aviation mechanics, ground operatives will no longer raise any plane from the ground", it is mentioned in a press release of the union.

Following the appearance of the "austerity law" (fiscal measures that will apply from January 1, 2024), the TAROM United Trade Union submitted a Memorandum to the Government and the Ministry of Transport exempting the company from its provisions.

"We find from the press, unsurprisingly, that once again Mr. Grindeanu, Minister of Transport, by discussing in the Government a Memorandum exempting CFR Călători, CFR Marfă and Metrorex from the provisions of this law, forgot about the TAROM aviation company. We want to ask him this way too, that he doesn't want to discuss with us on the trade union one specified by Law 367/2022, why is he discriminating again against the employees of the TAROM company? Isn't the aviation activity interesting for you, Mr. Minister?", show the trade unionists.

"Taking into account that TAROM is a public enterprise financed entirely from its own revenues, which operates in a competitive, constantly changing market, the restrictions imposed by the provisions of the Law, which can be explained in the case of public enterprises operating in a non-competitive market, in obviously, in the case of TAROM, they will prevent the efficient development of economic activities. TAROM will not be able to become profitable in these competitive conditions, in which competing private airline operators, Romanian or foreign, do not have to face restrictive conditions in the management of human, material resources and technical, so it is necessary to exempt the Romanian National Air Transport Company - TAROM SA from the application of the provisions by which the national air operator will be put at a competitive disadvantage, as a result of the impossibility of ensuring a normal regime in order to resolve the requirements operatively market", the trade unionists claim.

According to art. 6 of the Statute of the aeronautical personnel, the activity of the professional civil aeronautical personnel is carried out under special working conditions.

At the same time in art. 17 of this Statute provides that: "Salary rights of professional civil aeronautical pilots in civil aviation in Romania, including salaries, flight allowances, increments and other allowances, as well as specific rights regarding additional rest leave, recovery leave, travel allowance, accommodation conditions, food strengthening and protection of the body, health insurance, life insurance, accident insurance during the execution of flight missions and other specific rights are granted by the employer, differentiated, by personnel category, depending on: qualifications and licenses held, the activities and missions performed, the specific working conditions, the level of professional training, the position held on board the civil aircraft, the responsibilities granted and the risk assumed".

"The United TAROM Trade Union (SUT) has since July sent a Notification of the initiation of the Collective Labor Conflict registered SG with no. 3216/14.07.2023, notification to which many others will be added non-compliance with the CCM in force", point out the trade unionists.
