With the opening of the summer season, the number of routes and flights also increased, but the season of charter flights to holiday destinations also began. In this context, it is good to know that canceled or delayed charter flights may be eligible for financial compensation of up to 600 euros! Charter flights are subject to EU air passenger rights.

Passenger rights in air transport, provided by the EU, apply:

  • If the flight is performed on EU territory (regardless of whether it is operated by an EU or non-EU company)
  • If land at an EU airport coming from outside the Union, and the race is operated by an EU company
  • If take off from an EU airport to a country outside the Union, regardless of whether the flight is operated by an EU or non-EU company
  • If you have not already received any compensation (compensation, redirection, airline assistance) for flight issues under the relevant legislation of a non-EU country.

The rights of air passengers

If you fly on EU territory or from the EU to other non-EU destinations (regardless of whether the flight is operated by a company inside or outside the EU), you are also entitled to financial compensation of up to €600. These compensations are set according to the distance:

- 250 Euro for distance flights below 1500 km - regional and domestic flights
- 400 euros for flights between 1500-3500 km
- 600 euros for flights over distances over 3500 km (with a minimum delay of 4 hours)
- 300 euros for flights over distances over 3500 km (delayed between 3 and 4 hours)

These rights have been established by the EU faci fac part din the rights of air traffic passengers (To read). So we are not talking here about territorial laws or laws made by airlines, but about European Union directives.

If you have scheduled charter flights and they undergo schedule changes, if they are delayed or even canceled, check if you are eligible to receive financial compensation. Charter flights can be operated by companies specializing in such flights or even by airline companies that sublease the plane for charters. For example, if you have a Tarom flight delay, you can receive compensation if the criteria according to the EU regulation are met. As a general rule, to be eligible, operational disruptions should be caused by the airline.

How you can get these compensations

If you are faced with such situations, ask for your rights stipulated in EC Regulation No. 26/2004. You need the travel voucher which must show the time of departure and the time of landing at the destination. As a rule, you receive this information from the travel agency through which you purchase your tourist package.

Having the travel voucher, you can request compensation via email or dedicated electronic forms, to the travel agency from which you bought the flights / tourist package. If you do not resolve through the travel agency, request directly from the airline.
